Dylan Marshall

Associate Director, Financial Advisory

Dylan Marshall is an Associate Director with Teneo’s Financial Advisory business, having joined Teneo as part of its acquisition of KPMG Bermuda’s Restructuring business.

Prior to joining Teneo, Dylan was a Senior Manager at KPMG in the Deal Advisory team, where he worked on Restructuring and Corporate Finance engagements across a multitude of jurisdictions. Dylan has a wide range of Restructuring and M&A experience, having been involved in distressed asset and business sales, overseen debt restructuring, as well as coordinated the design and implementation of business solution for clients.

Dylan is a member of the Chartered Accountants Australia and New Zealand (CAANZ), Chartered Professional Accountants of Bermuda (CPA Bermuda) and also assists the Bermuda’s Restructuring and Insolvency Specialist Association (RISA Bermuda).

 

Selected Project Experience

  • Engagement manager of Project Hercules, which was the 2020 debt restructuring of the largest telecom group in the Caribbean which saw a debt reduction of $1.6 billion and interest payment savings of approximately $125 million. Through the engagement was thorough analysis, consultation and implementation of a Scheme of Arrangement with its creditors that was sanctioned in the Supreme Court of Bermuda as well as the New York Bankruptcy Court under a Chapter 15 arrangement.
  • Case managed various receivership appointments over Bermuda assets for on behalf of Banking Institutions ensuring that the underlying assets were protected, managed efficiently and then realized at the best possible market price.
  • Managed an intriguing mix of court supervised liquidations which have involved both domestic and internationally based company(s). These engagements involved asset realizations, informal restructurings, bringing claims against adverse parties, adjudication of complex claims, investigating and tracing undisclosed assets in other jurisdictions, administering distributions to various classes of creditors, as well as reporting to external parties which have included regulatory bodies (e.g. Bermuda Monetary Authority, Securities Exchange Commission etc.).
  • Managed the light touch Provisional Liquidation of an NYSE listed Oil & Gas services provider which underwent a $2 billion restructuring of its debt facilities via a plenary and parallel Chapter 11 bankruptcy proceeding in the United States.
  • Managed various Members Voluntary Liquidations (MVL) engagements in Bermuda as well as other jurisdictions. Entities were both stand-alone and also situated within complex structures that were subject to foreign laws.
  • Involved with a Conflict Liquidator appointment over a large number of disputed assets and litigation in multiple jurisdictions, including Cyprus, London, BVI, Cayman and Russia.
  • Prior to Teneo, involved in the Voluntary Administration of Relux Commercial Pty Ltd (In Liquidation)and in particular, in its landmark legal case in the Supreme Court of Victoria, Australia with respect to the Personal Properties Securities Act 2009 where assets valued in excess of $1.6m AUD were granted in the company’s favour (Relux Commercial Pty Ltd & anor v Doka Formwork Pty Ltd [2014]).
